Thank you for your interest in engaging TheMuDojo LLC to provide coaching services for you. This agreement is intended to set forth our understanding as to the nature and scope of the services I agree to perform for you, and the manner in which my fees for these services are determined. Experience has shown that an understanding of these matters will contribute to a better working relationship between Coach and Client, and that, in turn, makes our efforts more productive.

1. Nature and Scope of Services

Coaching is a collaborative process designed to support and guide individuals or groups of individuals in achieving personal and professional goals, enhancing self-awareness, and maximizing their potential to live a life they love living. The Client’s engagement of TheMuDojo and the services it provides are limited strictly to coaching services in the connection with projects the Client asks assistance with. In addition, TheMuDojo offers the unique combination of a proven, reliable and repeatable system for life transformation called DreamBuilder® developed by the Brave Thinking® Institute, with Emotional Freedom and Energy Psychology Techniques that may help the Client accelerate the processing and release of undesirable past events and core beliefs that don’t serve them anymore.

The Coach has been certified by the Brave Thinking Institute for delivering the DreamBuilder Program and is a Certified EFT Practitioner affiliated with the EFT Universe / Energy Psychology Group, Inc. The Coach is not a licensed healthcare provider, therapist, psychologist, or counselor, and the coaching services provided are not intended to replace professional health treatment or medical advice. Thus the Client understands and agrees that Client is responsible for their own well being, during and after their work with the Coach, and that Client is advised to inform their health care provider(s) before using these services, and consult with them before changing any medications or other treatments that they are currently undertaking.

Membership

In the context of TheMuDojo Expeditions, the duration of the membership varies but the Client stays in control with the month-to-month option. Each membership provides different levels of services, including regular live group coaching sessions, access to a private community of like-minded individuals that support each other, and additional services, perks and bonuses. The content of each membership can be changed at any time while our focus will be to ensuring that the level of value is maintained.

2. Client’s Obligations

You, as the Client, agree that you are motivated and committed to taking action on your personal and professional goals. You realize that anything less than your intentional full participation will not lead to your success. You agree to accept full responsibility for yourself and any actions you take that might result from coaching.
You acknowledge that you are healthy enough to engage in coaching and you agree to honor your scheduled session times.
In order to maximize the results you want to create, you understand that this is a no quitting and no refund contract and acknowledge that you intend to engage fully in this coaching process for the duration of your contract. You agree that there is no refund regardless of whether you actually participate or complete the Program.

3. Coach’s Obligations

As your coach, I will offer a system for accessing your capacity to create a life you LOVE in every way that matters to you. I will bring attentive listening, understanding, and belief in you when you may have a hard time believing in yourself. You can expect me to offer fresh perspectives, make requests, suggest action steps, acknowledge your wins, and guarantee utmost confidentiality (to the fullest extent of the law, and so long as I don’t fear for your or someone else’s safety).
While I as your coach cannot guarantee results, numerous clients of the DreamBuilder® Program have created powerful results by having the courage and determination to apply the principles taught in this program.
I am not a psychotherapist or a practicing physician, and I am not trained in diagnosing psychological or medical conditions. If any issues arise for you that I believe would be best handled by a licensed therapist or physician, I will suggest that you reach out to appropriate professional care.

4. Ethics

Either party may terminate the coaching relationship at any time, with or without cause. The Coach commits, to the best of their ability, to transparency regarding potential conflicts of interest, dual relationship issues, and/or the need to terminate the agreement.
If the Coach determines that coaching is not appropriate for you, they reserve the right to terminate the agreement, in which case they may refer you to a licensed mental health provider. The Code of Ethics for EFT Universe Practitioners is available at

5. Privacy and Confidentiality

I will keep all personal information that you disclose to me confidential and not disclose it to any third party without your express permission, except as required by law and ethical considerations such as:
If the Coach believes that someone is seriously considering or likely to attempt suicide;
If the Coach believes that someone intends to assault another person;
If the Coach believes someone is engaging or intends to engage in behavior which will expose another person to a potentially life-threatening communicable disease;
If the Coach suspects abuse, neglect, or exploitation of a minor or incapacitated adult;
If the Coach believes that someone’s mental condition leaves the person gravely disabled.

You understand that if you are in a crisis and need to speak to a counselor immediately, you will not use TheMuDojo or rely on the Coach. Instead, you will call 911 or your local emergency mental health services, or go to the nearest emergency room. Other crisis services include: www.befrienders.org, 1-800-SUICIDE or 1-800-273-TALK. Deaf clients can call 1-800-799-4TTY.
In case of an emergency during a coaching session, you agree to provide an emergency contact name and phone number to allow the Coach to alert someone you trust and who knows your location.

6. Non Disclosure

In the course of coaching, it may be at times necessary for you disclose information about your business that may be regarded as confidential. You may also be required to make decisions, which are sometimes difficult. You agree to provide me with all factual information and materials necessary to perform my services. We both agree to hold the Confidential Information obtained from the other in confidence at all times during and after the termination of this Agreement. Neither of us shall use or disclose such information, unless, until and to the extent the Disclosing Party consents in writing, or such information, know-how, inventions, discoveries, and ideas are or shall become generally available to the public, independently developed by the Receiving Party without use of the Confidential Information, lawfully received from a third party without using the Confidential Information, or such a disclosure is otherwise required by law.

7. Recording and Review of Sessions

Client understands that individual coaching sessions may be recorded through written notes, or video recording using a secure platform, by the Coach for the sole purpose of safety monitoring and peer mentor oversight. Any other use, such as educational use, will require specific and written permission from the Client.

It is understood that group sessions are recorded and made available to the specific membership private community it is intended for, for education purposes only and does not require any additional permission from anyone attending the session.

In any case, any such use will be done in a way to preserve Client’s privacy, name, location, and any other identifying information (other than as appears in a video-recorded content). Client agrees to not record all or any part of the coaching sessions.

8. Anonymity, Technology and the Internet

Although phone and videoconferencing provides the appearance of anonymity and privacy, online interactions are not devoid of risk. Client understands the potential risks of breach of confidentiality inherent to the use of technology and internet communications including the use of unencrypted email and cell phones. Client will refrain from discussing any personal concern via email or text message, outside of the sessions.

9. Fees

Please refer to the Fee Schedule of each individual membership plan and services. Payment is expected at the time the agreement is signed for the current month and on the first day of the month thereafter. Failure to pay any invoice rendered when due will constitute a default. In the event of a default, Client agrees that, at the discretion of the Coach, Coach may immediately cease access to the membership and its services.

10. Limit of Liability

Under no circumstances shall TheMuDojo or its agents be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, the services and any applicable product(s) under this Agreement. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, Coach’s liability in such jurisdictions shall be limited to the extent permitted by law. The maximum liability Coach has to any person, firm or corporation whatsoever arising out of or in the connection with the services provided under this Agreement shall in no case exceed the actual price paid to Coach by Client for the services (and/or products) whose use, or other employment gives rise to the liability.

11. Indemnification

Upon request by Coach, Client agrees to defend, indemnify, and hold TheMuDojo and its other affiliated companies harmless, and its employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney’s fees, that arise from Client’s breach of this Agreement or any of Client’s obligations hereunder.

12. Jurisdiction and Disputes

This Agreement shall be governed by the laws of the State of New Jersey. All disputes hereunder shall be resolved in the applicable state or federal courts of the State of New Jersey. You consent to the jurisdiction of such courts, agree to accept service of process by mail, and waive any jurisdictional or venue defenses otherwise available.

13. Waiver

No waiver by either one of us of any default shall be deemed as a waiver of any prior or subsequent default of the same or other provisions of this Agreement.

14. Severability

If any provision is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other provision and such invalid provision shall be deemed to be severed from the Agreement.

15. Client’s Agreement With Coach

Your Agreement to my work with you (by signing a copy of this agreement and proceeding with payment) constitutes your acceptance of the foregoing terms and conditions. If any of them is unacceptable to you, please advise me now so that we can resolve any differences and proceed with a clear, complete, and consistent understanding of our relationship. Furthermore, you understand that by signing this Agreement, you certify that no misrepresentation, false statements, fraud, intimidation, coercion, or duress were used to obtain this Agreement.
